Mersch Wins Federal Criminal Jury Trial

Statistically speaking, winning Federal criminal jury trials is an uphill battle. According to the United States Administrative Office of the Courts, approximately 91% of Federal criminal cases result in convictions. Over 97% of those convictions were the result of guilty pleas, meaning that very few Federal criminal cases go to trial.  

In 2014, 86,492 criminal cases were disposed of in United States District Court. About 8% of those cases were dismissed. Almost 89% of those cases ended in guilty pleas, leaving only 3% of cases to go to trial. Of that 3% of cases that were tried, 85% resulted in convictions. Of the 86,492 cases disposed of in year 2014, 2,219 criminal defendants went to trial, and only 331 were acquitted. Trying a case against the Federal government has become an uncommon occurrence, and winning the case is even more rare.
